This Privacy Policy describes how Envesko LLC, a limited liability company organized under the laws of the State of Wyoming, United States (“Envesko”, “we”, “us”, and “our”), collects, uses, and shares personal information when you visit our websites, including https://envesko.com and https://envesko.cloud (the “Site”), or use any of the services we provide, including web hosting, server hosting, software-as-a-service (SaaS), domain and related services, and other products and services (collectively, the “Services”).

This Privacy Policy applies across all of our Services. Certain Services, such as professional services like accounting, are governed generally by this Privacy Policy but may also be subject to their own or supplemental privacy notices; where a supplemental notice applies to a specific Service, it applies in addition to this Privacy Policy for that Service. You are encouraged to ask us about any privacy provisions specific to a Service. References in this Privacy Policy to the “Site” include our Services generally unless the context indicates otherwise.

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

• “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

• “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

• “Google Analytics” is used to track page load time and reduce errors.

• “Session-replay and product-analytics tools” (such as Microsoft Clarity) record interactions with the Site, such as mouse movements, clicks, scrolling, and the pages and features you view, to help us understand and improve how the Services are used.

Additionally when you make a purchase or attempt to make a purchase through the Site, you are redirected to our third-party payment processor and should review the applicable processor’s privacy policy. We may obtain information from the payment processor such as your name, email address, and phone number. This information is used to complete your order. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, processing the order, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: Communicate with you; Screen our orders for potential risk or fraud; and When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use third-party payment processors to power our payment and billing functions, and analytics providers to help us understand how our customers use the Services. The specific service providers we currently use, and links to their privacy policies, are listed in our Subprocessors list, which we maintain separately and make available on request. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

SECURITY

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure. Where payment card data is involved, it is transmitted using encryption and handled in accordance with applicable Payment Card Industry Data Security Standard (PCI-DSS) requirements by our payment processors. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee its absolute security.

DO NOT TRACK

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

However, because certain U.S. state privacy laws treat browser-based opt-out preference signals as valid requests, we honor the Global Privacy Control (GPC) signal as a request to opt out of any sale or sharing of personal information for the browser and device on which it is enabled.

YOUR PRIVACY RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information is primarily stored in the United States, although certain service providers may store or process it in other countries (such as the United Kingdom and New Zealand), as described in our Subprocessors list; it can be corrected, updated or deleted as required.

If you are a United States resident, you may have privacy rights under the laws of your state, including, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), and other comparable state privacy laws as they take effect. Depending on your state of residence, these rights may include: the right to confirm whether we process your personal information and to access it; the right to obtain a copy of it in a portable format; the right to correct inaccurate personal information; the right to request deletion of your personal information; and the right to opt out of the sale or sharing of personal information and of targeted advertising. We do not sell your personal information for money, and we do not share it for cross-context behavioral advertising.

You may also use an authorized agent to submit a request on your behalf, subject to our verification of the agent’s authority and of your identity. We will not discriminate or retaliate against you for exercising your privacy rights. We will respond within the timeframes required by applicable law, and where we decline a request, we will explain why and how you may appeal if an appeal right applies. DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

More generally, we retain personal information for as long as needed to provide the Services, maintain your account, and for legitimate business purposes, including complying with our legal, tax, and accounting obligations, resolving disputes, preventing fraud, and enforcing our agreements. When we no longer need personal information, we delete or de-identify it. Please note that we may be required to retain certain information even after you request deletion where retention is necessary to comply with a legal obligation or for another purpose permitted by applicable law.

MINORS

Our Services are intended for businesses and for individuals who are at least the age of majority in their state, province, or territory of residence, and are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under the age of 13. If you believe that a child under 13 has provided us with personal information, please contact us using the information below and we will take steps to delete it.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
